By accessing or using DetailNear.me (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
You must be at least 18 years old and able to form a legally binding contract to use the Platform. By using it, you represent that you meet these requirements.
DetailNear.me is a neutral directory that connects customers with independent mobile car wash and detailing businesses ("Washers"). We do not provide car wash or detailing services, do not employ Washers, and are not a party to any interaction, communication, agreement, or transaction between customers and Washers. Any arrangement you make with another user is solely between you and that user, at your own risk.
By listing your business, you agree to provide accurate, current, and complete information, and you are solely responsible for your listing's content. DetailNear.me may remove or modify any listing that is false, misleading, unlawful, or inappropriate, at its discretion.
The Platform lets users post content including listings, profiles, photos, reviews, and messages ("User Content"). You are solely responsible for the User Content you submit and represent that you own it or have all rights needed to post it, and that it does not infringe anyone's rights or violate any law. By posting User Content, you grant DetailNear.me a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute it in connection with operating and promoting the Platform. DetailNear.me does not endorse and is not responsible for any User Content, has no obligation to monitor it, and may remove, edit, or refuse any User Content at its sole discretion and without notice.
Customers may review Washers they have actually used. Reviews must be honest, genuine, and based on real first-hand experience. Fake, deceptive, AI-generated, incentivized, or abusive reviews are strictly prohibited, as is misrepresenting your identity or experience or attempting to suppress honest reviews. This policy is intended to align with the U.S. Federal Trade Commission's rules on consumer reviews and testimonials. Reviews reflect the opinions of the individual reviewers, not of DetailNear.me, and we may remove violating reviews but are not obligated to.
The Platform may use automated tools or artificial intelligence for functions such as organizing listings, detecting spam or fraud, and improving search. These features assist rather than replace human judgment, may contain errors, and should not be relied on as professional advice. We disclose the use of such tools in the interest of transparency. Users may not use AI or automation to generate fake reviews, fake listings, or other deceptive content.
Free listings are available to registered Washers. Pro and Elite plans are paid subscriptions billed monthly or annually and processed by our payment provider, Stripe. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis. You are responsible for all charges incurred under your account.
The Platform and its original content, features, and branding are owned by DetailNear.me and protected by applicable laws. If you believe content on the Platform infringes your copyright, email support@DetailNear.me with: (1) your contact information; (2) identification of the copyrighted work; (3) the URL or location of the material you claim infringes; (4) a statement that you have a good-faith belief the use is unauthorized; and (5) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them. We respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA), may remove infringing content, and may terminate repeat infringers.
You may not use the Platform to post false or infringing information, spam or harass users, scrape or harvest data, reverse engineer or disrupt the Platform, impersonate others, or engage in any unlawful or harmful activity.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. DetailNear.me does not warrant the accuracy, quality, safety, licensing, insurance, or legality of any Washer, listing, review, or service found through the Platform. You engage any Washer and use the Platform at your own risk.
To the fullest extent permitted by law, DetailNear.me and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for damages arising from disputes or interactions between customers and Washers, the quality or outcome of any service, User Content, or loss of data, profits, or goodwill. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Platform will not exceed the greater of the total amount you paid us in the twelve (12) months before the claim or USD $100.
You agree to indemnify and hold harmless DetailNear.me and its owners, employees, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, your User Content, your interactions or transactions with other users, or your violation of these Terms or any law.
These Terms are governed by the U.S. Federal Arbitration Act and the laws of the United States and of the state in which DetailNear.me is principally operated, without regard to conflict-of-law rules. Please read this carefully, as it affects your rights: any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be finally resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules, rather than in court — except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property or unauthorized-use matters. To the extent permitted by law, disputes will be handled only on an individual basis; you and DetailNear.me each waive any right to participate in a class, collective, or representative action. If any part of this section is held unenforceable, the remainder remains in effect.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
